These Terms of Use (the “Terms”) govern your use of the reservation services made available by Tableo Ltd (“Tableo”, “we”, “us”, or “our”) to patrons/guests who book a table at participating restaurants or other venues (“Restaurants”) via:

  • a Tableo-hosted booking widget embedded on a Restaurant website (the “Sites”),
  • any third‑party channel integrated with Tableo (e.g., Reserve with Google, Instagram, Facebook, WhatsApp, Michelin, Bookia etc.), or
  • bookings taken by a Restaurant via phone/email and entered by the Restaurant into the Tableo system on your behalf.
  • Collectively “Channels”.

By submitting a reservation, you agree to these Terms. If you do not agree, please do not use the services.


1. Who we are & what we do

Tableo Ltd provides software that enables Restaurants and other venues to manage reservations and guest communications (“Services”). We are not a seller of food or beverages, not a party to your dining transaction, and not an agent for you. Your dining experience—including menu, pricing, service quality, table allocation, and onsite policies—is provided solely by the Restaurant under its own terms and conditions.

  • Tableo may transmit your reservation details and communications to the Restaurant and send you confirmations, reminders, updates, or post‑visit review requests on the Restaurant’s behalf.
  • Tableo does not set Restaurant policies (e.g., deposits, cancellation windows, no‑show fees, holding times) and does not guarantee availability or seating.

2. Eligibility & using the services

  • You must be at least 16 to use the services. If the booking involves any deposit, pre-authorisation, card capture, or potential no-show fee, you must be 18—otherwise a parent/guardian must make the booking using their details.
  • You agree to provide accurate contact details and any information the Restaurant reasonably needs (party size, special requests, dietary notes, etc.).
  • You are responsible for monitoring confirmations and reminders we or the Restaurant send to the contact details you provide.
  • By submitting a reservation, you confirm you meet these requirements, and the Restaurant may refuse service if you do not.

3. How reservations work

3.1 Confirmation. After you submit a booking request, you will usually receive an on‑screen confirmation and/or an email/SMS. Some Restaurants operate with request‑to‑book workflows; in that case, confirmation may follow later or alternative times may be offered.

3.2 Modifications & cancellations. A reservation may be modified or cancelled by you or by the Restaurant, in all cases subject to the Restaurant’s policy and availability. Use the links/instructions in your confirmation or contact the Restaurant directly. Where a channel (e.g., Google) offers self-service options, availability of those options depends on the Restaurant’s settings. If the Restaurant changes or cancels, it will notify you using the contact details you provided. Any deposit, pre-authorisation, or no-show terms apply per the Restaurant’s policy at the time of the change/cancellation.

3.3 Arrival & holding time. Restaurants generally hold tables only for a limited time after the booked time. If you are running late, contact the Restaurant. Tableo does not control seating decisions.

3.4 Group bookings & special events. Restaurants may apply different rules (deposits, pre‑orders, fixed menus). Always read the Restaurant’s terms presented during booking.


4. Card capture, deposits, pre‑authorisations & payments

Some Restaurants may require a card capture, deposit, pre‑authorisation, or full/partial pre‑payment to secure a booking or for specific services (e.g., events). When you provide card details:

  • Your card is processed by our PCI‑compliant payment partner (currently Stripe, Inc.) and tokenised for the Restaurant’s use in accordance with the Restaurant’s policies. Tableo itself does not store your full card number or CVV.
  • The Restaurant may charge or pre‑authorise per its policy (for example, for no‑shows, late cancellations, or deposits) and is solely responsible for any resulting charge, refund, or dispute handling.
  • By supplying card details, you authorise the Restaurant to make permitted charges under its posted policy. Read the policy carefully before confirming.
  • Refunds, if any, are handled by the Restaurant under its policy.

No‑shows & late cancellations. Each Restaurant sets its own rules and fees. If you do not cancel within the stated window or fail to attend, the Restaurant may charge the card you provided. Tableo is not responsible for such charges.


5. Communications

By booking, you consent to receive transactional communications (confirmations, reminders, updates, follow‑ups) by email and/or SMS/WhatsApp from Tableo and/or the Restaurant. Message and data rates may apply.

Marketing communications, if any, require your separate, explicit consent and can be withdrawn at any time using the unsubscribe instructions provided.


6. Restaurant policies & third‑party terms

Restaurants may display or link to their own Terms of Service, House Rules, and privacy notices. Those apply in addition to these Terms.

If you use a third‑party channel (e.g., Google, Meta), that channel’s terms also apply and may affect how you modify/cancel bookings and how your data is processed.


7. Accuracy of information & content

Tableo aims to present accurate Restaurant information (hours, menus, prices, policies), but content is provided by Restaurants and may change without notice. We do not guarantee accuracy, availability, pricing, or service levels.

If the services include guest‑generated content (ratings/reviews), you agree that your content will be lawful, respectful, and truthful. You grant Tableo a non‑exclusive, worldwide, royalty‑free licence to host, display, and share that content with the Restaurant and on integrated channels. We may moderate or remove content at our discretion.


8. Acceptable use

You agree not to:

  • use the services for any unlawful purpose or to harass or harm others;
  • submit false bookings, multiple duplicate bookings, or otherwise interfere with Restaurant operations;
  • attempt to access or scrape the services by automated means contrary to our technical controls;
  • misrepresent your identity, contact details, or party information.

We may suspend or block your access to the Services if we reasonably suspect misuse.


9. Privacy

Your personal data will be processed as described in the Tableo’s Guest Privacy Policy (linked or shown on the booking form) and, where applicable, the Restaurant’s privacy notice.

  • When a Restaurant takes your booking by phone or email and enters it into Tableo, the Restaurant is responsible for lawful collection and sharing of your data with Tableo.
  • Tableo generally acts as a data processor on the Restaurant’s behalf for reservation management; for certain channel features (e.g., messaging or analytics), Tableo may act as an independent controller as explained in the “Data Processing” subsection and “Guest Privacy Policy”.

Additional information on how personal data is collected and used is set out in Tableo’s Privacy Policy for Restaurants and Tableo’s Privacy Policy for Guests (together, the “Privacy Policies”), which are incorporated by reference.


10. Intellectual property

The services and all related software, branding, and content are owned by Tableo or its licensors. You may use the services only for personal, non‑commercial reservation purposes. You may not copy, modify, reverse engineer, or redistribute the services except as permitted by law.


11. Service availability & changes

We may change, suspend, or discontinue any part of the services at any time. We are not responsible for failures caused by Restaurants, third‑party channels, telecom providers, or events outside our reasonable control.


12. Disclaimers & limitation of liability

Disclaimers. The services are provided on an “as is” and “as available” basis. Tableo does not guarantee uninterrupted or error‑free operation, or the accuracy or completeness of Restaurant content. We do not control Restaurant actions or outcomes and are not responsible for the quality of food, service, seating, pricing, policies, or any on‑premise matters.

Limitation. Under no circumstances will the company be liable for any injuries, death, loss or damage caused by your use of the site, including any software, materials, content, food, products and/or services provided or use or reliance on information obtained through this site. It is your responsibility to evaluate the accuracy, completeness, or usefulness of this site and the resources, materials, content and software provided therein. In no event shall the company be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of or relating to the site or this agreement, whether based on warranty, contract or any other legal theory. Your sole remedy for dissatisfaction with this website is to stop using this website.


13. Indemnity

All Users agree to indemnify and hold the Company, its subsidiaries, affiliates, officers and employees, and service providers harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of a User’s use of the Sites, the User’s violation of this Agreement, or the User’s infringement of any intellectual property or other right of any person or entity. Even though prohibited, people may provide information that is offensive, false, harmful, or deceptive. The Company assumes no responsibility or liability whatsoever for such content or actions.


14. Third‑party links & services

The services may link to third‑party websites or include third‑party components (e.g., payment processors). Some links and content displayed in the booking widget are supplied by the Restaurant (for example menus, house rules, deposit/no-show policies, maps, or social media). Tableo does not review or endorse such third-party content and is not responsible for it. Your use of those sites/services is governed by their own terms and privacy notices.


15. Changes to these Terms

We may update these Terms from time to time without prior notice. The version displayed at the time you submit a booking applies to that booking.


16. Governing law & jurisdiction

These Terms and any non‑contractual obligations arising out of or in connection with them are governed by Maltese law. The courts of Malta shall have exclusive jurisdiction, without prejudice to any mandatory consumer protections that apply in your place of residence within the EU/EEA.


DATA PROCESSING

Definitions

For purposes of this Data Processing section only:

  • Subscriber” means the Tableo service user—i.e., a restaurant or other hospitality operator that holds an Account with Tableo.
  • Service Provider” or “Tableo” means Tableo Ltd.
  • Guest” or “Guests” means individual patrons who make or hold a reservation via the Services.
  • Parties” means the Subscriber and Tableo collectively; each is a “Party.”

1. The Parties understand and accept that the services regulated by this Agreement depend on the processing of personal data. Accordingly, the following provisions shall apply to all matters relating to the processing of personal data in connection with the Service:

  1. The Service Provider (Tableo Ltd.) shall process all or any personal data strictly in accordance with the provisions of the General Data Protection Regulation (EU Regulation 2016/679) (the ‘GDPR’) and the Data Protection Act (Chapter 586 of the Laws of Malta) (the ‘Act’) (collectively the ‘Data Protection Laws’). The Service Provider may, depending on whether it has effective control over the purpose or destination of any personal data or not, act either as a controller or a processor, as defined in the Data Protection Laws. The provisions of this Clause shall apply only in those instances where it acts as a controller.
  2. Purpose of processing: the purpose of processing by the Service Provider is that of delivering the Service, and to provide ancillary and support services (such as maintenance and other back-end support) connected to the Service. To this end, therefore, the processing of personal data will be based primarily on the performance of a contractual service offered by the Service Provider.
  3. The categories of personal data that may be processed by the Service Provider shall typically include the name of the Subscriber, its business hours and capacity; booking information about the Subscriber’s patrons, as may be entered either directly by such patrons or by the Subscriber; any free text that may be provided by any patron or by the Subscriber, and which text which may include special categories of personal data (including allergy information).
  4. The recipients of any personal data shall be limited to the Service Provider and, where necessary, its direct suppliers who shall each be bound to process any such personal data in accordance with the standards and provisions set out in this Agreement.
  5. Any personal data shall be stored for up to 2 years.

2. The Subscriber understands and agrees that the Service requires the processing of personal data of the Subscribers’ users. For the purpose of processing incoming calls & bookings originating from outside the Business to the Subscriber, in such a scenario the Subscriber acknowledges that he is the Data controller of such personal data and that Tableo Ltd is the Data Processor as defined under applicable data protection legislation.

3. Where necessary, to enable the Service Provider to render its Service, the Subscriber authorises the Service Provider to process personal data on the Subscriber’s behalf in accordance with this clause as Processors. The Service Provider shall otherwise act on the instructions of the Subscriber when processing the Subscriber’s personal data.

4. The Service Provider shall not transfer the Subscriber’s personal data outside the EEA, Switzerland or any other country which has received a binding adequacy decision unless pursuant to and in accordance with signed EU Standard Contractual Clauses or any other legally permitted data transfer mechanism.

5. The Subscriber will not instruct the Service Provider to perform any processing of personal data that violates any data protection law. The Service Provider shall suspend any processing and/or the Service if the Service Provider reasonably suspects that the Subscriber’s instructions may violate applicable data protection legislation.

6. The Service Provider shall inform the Subscriber without undue delay should the Service Provider become aware of any data breach in relation to the Subscriber’s personal data. In making personal data available to the Service Provider, the Subscriber confirms to have complied with the law and that the Subscriber will process personal data and administer its rights in accordance with the Subscriber’s legal obligations as Data Controller.

7. You acknowledge that the Service Provider shall have a right to process data relating to the operation, support and/or use of the Services for the Service Provider’s business purposes, such as billing, account management, technical support, product development and sales and marketing. To the extent any such data is considered personal data under applicable data protection legislation, the Service Provider is the Data Controller of such data and accordingly shall process such data in accordance with data protection legislation.
